Terms of Service

These Terms of Service ("Terms") are a contract between you and Empakt Financial Inc. ("we", "us") and govern your use of the Mashal service available at mashal.app and any related products (collectively, "the Service"). By creating an account or using the Service you agree to these Terms. If you don't agree, don't use the Service.

1. The Service

Mashal is a social-intelligence platform that connects to your authorised social media accounts via their official APIs, fetches public metadata about your posts, optionally tracks competitor handles, and generates an AI-powered daily intelligence brief. Specific features are described on the features page.

2. Your account

2.1 Eligibility

You must be at least 16 years old to use Mashal. If you are using Mashal on behalf of an organisation you represent that you have authority to bind that organisation to these Terms; in that case "you" means both you and that organisation.

2.2 Account security

You are responsible for keeping your account credentials confidential and for all activity that happens under your account. Notify us immediately at hello@mashal.app if you suspect unauthorised access.

2.3 One person, one trial

The 7-day free trial is intended for one trial per person or organisation. Creating multiple accounts to extend trials beyond the 7-day window is grounds for suspension. We track previously-connected social handles globally and will refuse to bind a handle that has already used a trial under a different account.

3. Plans, payment, and trials

3.1 Free trial

Every new Mashal account starts on a 7-day free trial with scrape-only feature access (1 workspace, 2 social accounts, 2 competitors, last ~10 posts per account on first fetch). No credit card is required to start the trial. On day 7, your access reverts to read-only unless you choose a plan. Your data is retained for 30 days after that before deletion.

3.2 Plans and prices

Plans are listed on the pricing page. Prices are quoted in USD. Plans are billed per workspace, per month, in advance.

3.3 Payment

Payments are processed by Stripe. By providing payment information you authorise us to charge that method recurrently for your chosen plan until you cancel. You are responsible for keeping payment details current.

3.4 Taxes

Listed prices exclude VAT, GST, or any applicable sales tax. Where required by law we add the applicable tax to your invoice.

3.5 Failed payments

If a payment fails we'll retry over 7 days and email you each time. After 7 days of failed retries the workspace moves to read-only. After 30 days without successful payment we may delete the workspace; we'll email you 7 days before that happens.

3.6 Cancellation

You can cancel any time from Settings → Billing. Cancellation takes effect at the end of your current billing period. You keep full access until then.

3.7 Refunds

We don't offer refunds for partial months. If we materially degrade or remove a feature without offering a comparable replacement, we'll refund a prorated portion of your current cycle at your request.

3.8 Price changes

We may change plan prices. Existing subscribers will be notified by email at least 30 days before a price change takes effect for their account, and the new price applies on the next renewal after that 30-day notice.

5. Third-party platforms

Mashal depends on the APIs and policies of third-party platforms (Instagram, TikTok, YouTube, LinkedIn, Facebook, X, Snapchat, and their respective parent companies; Zernio; Apify; Anthropic; Google; Resend). Your use of Mashal is subject to those platforms' terms of service. If a platform deprecates an API, changes its terms, or revokes your access, Mashal's coverage of that platform may degrade or be removed. We have no control over and no liability for third-party platforms.

6. Intellectual property

6.1 Your data

You retain all rights to the social-account content and metadata you authorise Mashal to access. You grant Empakt Financial Inc. a limited, non-exclusive licence to process this data solely to provide the Service to you.

6.2 Mashal

Empakt Financial Inc. retains all rights in the Mashal software, design, brand, and aggregated analytics derived from anonymised data (for example, "creators in the GCC average X engagement rate"). You may not copy, modify, or redistribute the Service.

6.3 Briefs and outputs

The AI-generated briefs, reports, and analyses are yours to use however you like — internal slides, client decks, social posts. We ask that you don't claim them as our endorsement.

7. Confidentiality

Each party will keep the other's non-public information confidential and use it only to perform under these Terms. This obligation survives termination.

8. Availability and support

We target 99.5% monthly uptime but do not guarantee it. Scheduled maintenance is announced at least 24 hours in advance via email. Support is provided by email to hello@mashal.app; we aim to respond within one working day.

9. Termination

You can terminate at any time by cancelling your plan and / or deleting your account from Settings. We may suspend or terminate your account immediately if you breach these Terms, fail to pay, or use the Service in a way that creates legal or reputational risk for Empakt Financial Inc. On termination we delete personal data within 30 days, subject to legal retention obligations.

10. Disclaimers

The Service is provided "as is" and "as available". To the maximum extent permitted by law, Empakt Financial Inc. disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. AI-generated content may be inaccurate; you are responsible for verifying briefs before acting on them. Decisions based on Mashal outputs are made at your own risk.

11. Limitation of liability

To the maximum extent permitted by law, Empakt Financial Inc.'s aggregate liability for any claim arising out of or relating to the Service is capped at the greater of (a) the fees you paid us in the 12 months before the event giving rise to the claim, or (b) USD 100. Empakt Financial Inc. is not liable for indirect, consequential, incidental, special, or punitive damages, lost profits, lost revenue, or lost data, even if advised of the possibility of such damages.

12. Indemnification

You will defend and indemnify Empakt Financial Inc. against third-party claims arising out of your breach of these Terms, your misuse of the Service, or your violation of applicable law.

13. Governing law

These Terms are governed by the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable in Ontario, without regard to conflict-of-laws principles. Each party submits to the exclusive jurisdiction of the courts of Toronto, Ontario for any dispute arising out of or relating to these Terms — except that Empakt Financial Inc. may seek injunctive relief in any jurisdiction.

If you are a consumer based in the EU/EEA or the UK, mandatory consumer-protection rights in your jurisdiction are not affected by this clause.

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified to active customers by email at least 30 days before they take effect. The "Last updated" date above always reflects the current version. Your continued use of the Service after a change constitutes acceptance.
